Tore My Acl During Slip And Fall

On Jan 31, 2011, I was taking my mother in law back to her hotel after I had gotten off of work.  I noticed as soon as I opened the car door the sidewalk was a sheet of ice.  I helped my mother in law inside but on my way back to the car I slipped and fell and tore my acl. I was wearing slip resistant shoes at the time.  The hotel told me they only salt once in the morning at 9:00 am and I fell around 9:00 pm. The hotel still had not put out salt 3 hours after I fell.  Does the weather forecast exempt the hotel from liability?  This happened in Columbia, MO and the forecast that day was: Occasional freezing rain in the morning, then occasional freezing rain turning to freezing drizzle and snow and sleet in the afternoon. Snow is likely with occasional freezing drizzle and sleet likely in the evening.

I am sorry to hear about your fall on the ice and the injury you suffered. Will your torn ACL require surgery or can you treat it with physical therapy?

You want to know about the liability of the hotel for your fall on the ice. I need to caution that I practice personal injury law in the New York metropolitan area and am not an expert on Missouri law. That said, in general, you would need to prove the hotel was negligent in not clearing the path of ice.  A policy that says they need only put out salt once in the morning sounds inappropriate to me. It would seem to me that the hotel had an obligation to clear the walk more than once a day given the weather conditions. Under New York law, I believe that you would have a valid claim.  Having torn your ACL, you certainly have suffered a substantial injury due to the apparent negligence of the hotel.
