Traffic accident. Fault side insurance doesn't want to pay.

Hello,

I was involved in traffic accident on the parking lot. When my car was already completed backing and I was switching gear from "reverse" to "drive" I saw through the window that other car started backing from parking space approaching my car. I couldn't drive forward because there were still cars in front of me so I was giving way to them. I started honking but car continue backing until it hit my car. The guy mentioned to me after accident that I appeared from nowhere. Also he made a statement to police officer who arrived at the scene that he didn't see my car stopped behind his. My insurance company can do nothing because the damage is less than my deductible, but the guy company told me they could offer only 55% of damage. The guy told his insurance company that we both were moving at the time of accident. That is not a true and he mentioned different things to police officer. I have police report with statement made by the guy and I sent it to his insurance, but it didn't help.
I don't want to pay for damage if it is not my fault at all. What are my options? Thank you in advance.
