Tubal Ligation

Hi I have just had a baby 3 months ago and at different times after talking to my obgyn doctor he did not remember doing my tubal ligation but consents where signed, example at my 6 week check up asking me what birth control I wanted saying he forgot to document it on my chart I'm pregnant..

I would say he forgot to do it during the c-section even though consents where signed at the hospital and 1 month prior to the c-section, what should I do? Do I have a case

how can I prove he didn't do it is there a test to check or is the fact that I'm pregnant enough? Thank you for taking the time to answer my questions I really appreciate any input that you can give me. Kelly Greer

You should be able to have an MRI or perhaps even just an X-Ray to see what was, if anything, done.

I'd see a lawyer first and have him choose the doctor to examine you. You probably do have a malpractice case. What it is worth in dollars I don't know, maybe not much if you have to have the tubes tied now and have no further trouble; the cost of surgery and a little for your added risk and discomfort.

However, that doctor has Altzheimer's, a drinking or drug problem, or is mighty careless. How old is he/she? Whatever his problem is he needs to be reported. Perhaps your lawyer can base his case on this doctors mental state. That will be up to him, but if I were a lawyer with this case the first thing I would do is get the Board of Medical Examiners on him.

Try first to find a lawyer through your local Bar Association. If that doesn't help, then go to the Yellow Pages and start calling malpractice lawyers. You may have to call a few. Don't give up too quickly.

However your case turns out, if your lawyer has not done it, then you write a report, typed, one page, to the Board of Medical Examiners or whatever the licensing board is called in your State. That guy needs to be drummed out of the profession.
