What rights do i have as a contract for hire "employee" in Texas. The company is taking up to 2 months to pay?

I have been working for a tv production company for about 9 years. In the past year they have started paying their contract for hires every 6 to 8 weeks, sometimes longer. They also changed the contract and took out the length of time they will take to pay us, leaving it open. I think the law in texas is 90 days for contracted people but im not for certain. Just wondering if i have any ground to stand on as far as demanding or taking action. at this point im sick of dealing with them and ive got nothing to lose by doing so. there is a lawyer on staff at this comapny...

So which is it -- contractor or employee?

If you are a contractor you are self-employed and labor laws don't apply to you. If your client or customer is slow to pay, add on interest charges and take them to court if need be. That's your only redress.

If you are an employee then you must be paid within a "reasonable period of time" after completing the work period. While reasonable is not defined by law, by the end of the next pay period if you are paid weekly, every 2 weeks or twice monthly or within 2 weeks if you are paid monthly would generally be considered the outer limits of reasonable. If you are not paid on time, call your state labor board -- Texas Workforce Development in your case.
