What Would You Do If You Were In A Fairly Serious Car Wreck And Your Air Bag Didn't Release And You Got A Concussion?

I had an accident and my airbag didn't work I banged my head real hard, what should I do, Do I have a lawsuit and if so who would I sue? What would you do???

Take the car to a mechanic you have not used before, and have them try to figure out why the air bag did not deploy. There could be many reasons. It could have been disconnected by accident during prior maintenance. It could be operating correctly, but the forces of the accident were not the kind it was designed to respond to. This will have to be determined first.   You can also talk to a lawyer. Some lawyers give a free initial consultation for accident victims, and they can evaluate the probability of success for your claim, but they will ask the same questions about why the air bag did not deploy. The inspection results will be crucial.   You can also talk to your insurance company. They have permanent legal employees, and they are always looking for ways to spread the risk of losses. If the air bag failing to deploy cost them additional money, they may be able to recoup their losses by negotiating with those responsible for the air bag failure. But again, the parties responsible for the failure will have to be determined by examining the car.   I hope this helps.

If you suspect a design flaw, or negligent maintenance, you should have the car inspected. I'd document the seriousness of your injury and make sure that your doctor monitors you carefully. Second, I'd get the advice of a good lawyer. If your car has been serviced at any point and the failure to deploy was due to the negligence of the mechanic, that's who'd you'd sue. If the failure to deploy was due to a manufacturing defect or a design flaw, you'd sue the manufacturer. In any case, you'd have to prove you suffered damages of some kind, hence the need to visit the doctor and DOCUMENT everything. Even if you only suffered a headache, those are damages though you probably won't be able to collect much on that. If your injury is more extensive, then whoever was at fault should pay for your medical expenses as well as the repair of your car. And you may also be able to collect punitive damages if negligence was involved.But you've got good reason to see a doctor and see a lawyer.Good luck!!

In regards to the airbag, you may want to consider whether the airbag actually 'malfunctioned' in not deploying. The National Highway Traffic Safety Administration says " Front air bags are not designed to deploy in side impact, rear impact or rollover crashes." They also have some comments on the relative speed necessary to deploy an airbag. I certainly cannot tell you if you have a case related to your accident. I can say that following an accident, consulting an attorney can be a reasonable course of action to consider.
