Who will be at fault for an accident in NC?

Postby josephus » Wed Nov 30, 2011 7:12 am

This morning I was involved in a 3-car accident. The other two cars were both in front of me. The front-most car slammed on her brakes to make a left turn from the traffic lane we were all in, ignoring the turn lane right next to her. The lady in front of me slammed on her brakes and I slammed on mine.

However, the roads were wet and my car slid when I hit my brakes. The one in front of me hit the lady who had stopped to turn and I hit the lady in front of me.

I know it's normally the driver who hits from the rear who is at fault, but can the lady in the front who made an improper turn from a through-lane of traffic be held liable for any damages? I should mention my car is severely damaged, the one in front of me had her bumper knocked down a bit, and the front most car barely got scratched, though she claims she was "slammed" into.

Is NC law going to hold me responsible for all damages, or could some of the blame be placed on the front car for turning incorrectly?

You don't say who, if anyone received a ticket. That will likely be the determining factor as to fault. It sounds to me all are at fault...the back two for "following to close". My guess would be that all will be responsible for their own vehicle damage, but depending on the ticket thing, you may be wise to consult an attorney, especially if you are liable for the damage to the other vehicles.

usually these type of thing are hard to prove since if it was wet the police most likely assumed that you slammed into the car in front of you and pushed her into the 1st car

It's not always the fault of the one who rear ended someone. The person who was trying to make a left and slammed on brakes is at fault.

The roads were wet so you should of had a safer distance. If they are like everyone else the rear end collision is the fault of the person who rear ends someone.
