You should be able to receive your benefits because you were laid off. The layoff was out of both parties control so your benefits "shouldn't" be affected at all.

Before you get an attorney talk with the adjuster and ask these questions. Typically most states tell the insurance company to continue benefits if a claimant was laid off.

If you have been released to full duty the workers compensation payments will end. They will start back up after your surgery but in between you will have to file for UI.

I don't really understand why you hired a lawyer. It isn't like he got you anything you wouldn't have gotten without him but that is your business.
