Damaged Environmentally Protected Vegatation

Postby Apollo » Fri May 09, 2014 4:05 am

I own submerged land on a non navigatable lake that has no public access.
The problem I am having due to flooding in the area is that my lake view taxed and assessed neighbor is damaging my vegetation to get into the lake now that the water is flowing over my land and into the tip of his.
What can I do? The local DEP have not been useful so far the estimated damage is only near $200

To trespass is both a criminal and a civil issue.Have you sorted out how to properly notice your neighbor/post your lands for no trespassing under FL laws? You can seek both criminal citations and sue for damages--to vegation etc....Hey it may be only serious card you have to play?

How can I seek criminal citations when he lies to the police about the property boundaries.
Is a boat over property line and damaged plants enough proof? The boat is registered

I have sent the police there so many times and this jerk lies to them, tears down my no trespassing signs and stakes with post.
I have sent him certified letters that I will not allow a easement that he is a trespasser.
How can I get criminal citations when He lies to the police.
I have pictures and noted damages from DEP files can I utilize that?

Damaged Environmentally Protected Vegatation

I have put stakes plants and the like there on my side of the property line and he tears it all up, sometimes my personal property is left damaged and other times missing.
I have permission to place intervals of pvc there in the conservation area I guess I will try that, but from experience this neighbor is essentially a Freddy Kruger when you think the nightmare is over it resurfaces.
If I get an injunction I will most likely have the same scenario as now where he lies to the police about property lines.
Thanks for advice will try and value any value any input I get.

You have to keep in touch with people in DA's workplace concerning the legal aspect of trespassing....Doesn't issue if he disturbes 1 edge of lawn--if he's trespassing he's trespassing. But the requirements to show civil problems might be less than the legal aspect if you may show it had been he who ruined your countries and indicators perhaps you are effective having a civil match for same...and that I'd find expenses as well.If a ship truck reduces a mentality --the expense to reair stated mentality with a qualified landscaper within an environmentally protected region is quite high---if you go directly for his wallet he might not think it is humorous...

I've indigenous government protected vegetation there he is pressing a ship through. He'd a navigational easement drafted by his lawyer years back and that I delivered him a professional notice decreasing and requesting him to maneuver encroachments grab trespassing etc. Btw: I've paperwork aimed towards me declaring that I really could get fined for this kind of damage.

Can you legally build a fence? If so, build your fnce on the property line and I suspect all of the other issues will go away.
