Evicting An Unleased Tenant/occupant

Postby Meinhard » Mon May 19, 2014 12:29 am

This question comes from a landlord in Ohio.  I had a single tenant who brought in a roommate w/o notifying me.  Several months later, my tenant and her new roommate had a dispute over bedbugs so my tenant chose to move out. Apparently this new roommate brought infested my unit with bedbugs.  So I now have an occupant living in my unit for which I have no lease.  I do know her name.  When I asked her to fill out an application to eventually sign a lease she held off.  A few days ago she told me she's going to move out at the end of August, one month and a day from now.  She also said she'd soon pay rent for August.  If she fails to pay rent by the 3rd day of the month I plan to give her a 3-day notice and threaten eviction.   If this transpires, do I also need to evict my now absent tenant?  Because my tenant vacated w/o giving notice leaving an unlease occupant in my unit, do I need to give my former tenant her deposit back?  Can I use the deposit, or part of it, to hire an exterminator?  Thx.

august_west:If this happens, do I also have to evict my today missing tenant?
If they're eliminated possibly not.  You evict the particular residents.
august_west:Since my tenant left t/e providing notice making an unlease tenant in my own device, do I have to provide my previous tenant her deposit back?
When the rent claims that you don't:  no.
august_west:Could I make use of the deposit, or section of it, to employ an management?  Thx.
You should use the deposit for several proven damages.

Evicting An Unleased Tenant/occupant

Recommendation from the retired LL:
This isn't your tenant, there's no agreement /rent together with her---but when you receive into some kind of cope with her she becomes your tenant and also you have to do the entire due process exercise to obtain her out. An individual's guarantee to pay for or leave has common strength of moist toilet paper. The simple fact that she's there might produce some kind of tenant at sufferance standing
NO, your tenant having a rent hasn't surrendered a clear device for you --you wish to trim hardon the tenant to obtain the visitor E-U-T  and he or she owes you till it gets done.  you would like your tenant to become unpleasant and obtain visitor out--both hands might be linked if one enters appropriate specifics.

Your jawbone might be much better than due process.

Personally I actually don't believe you will want person inside t/e a well crafted rent plus some credit/history investigations -- you could find which come July she goes in 2 pals ?
