Eviction On Door

Postby Curadhan » Wed May 14, 2014 9:09 am

I recieved an eviction on my door of the mobile home I am buying and living in. I got it dec 26th and was to leave jan.3. then I had by feb 27th.to remove my mobile home.  it stated that I had 4 violations for a dog. . other people that rent her trailers have dogs. .when I first moved in, I was not even allowed to have my lab or my boxer had a large fence she said I had to get rid of it. There are no "dangerous dog" Laws where I am at. we brought our sons rott home with us. he is licensed, and has different type of obedience classes. the landowner  said her insurance will not allow her to have a rott in the trailer park. then to top it off, our older son was coming from another state for thanksgiving. he had just gotten a puppy. so we asked her if he could bring the puppy. she said "it's your place". and asked what kind of dog it was. we didn't know. well it turned out the dog was a Italian cane corso ( mastiff). it was only 8 weeks old. when she saw the dog she wanted him off the property immediatly. I couldn't believe it. well right after thanksgiving the landowner hired someone to cut trees down. to make a long story short the lift was suppose to stop when shut off and it didn't and ran into the carport that came down on both of our vehicles. my insurance is going after her for the deductible and the cost of repairs and we are suing her for the cost of my husbands vehicle. she is really mad and I believe she is using the dog issue to evict us. and now she is slandering my husband to people we know. can we fight the eviction.? can we sue her for and illegal eviction, and descrimination because of the dog issue.? can she really pick and choose who can have dogs and what kind when I own my mobile home?

Eviction On Door

If the lease allows for no dogs the LL can selectively enforce same-or merely not renew a monthly lease.
If the LL had allowed you long term  possession of a dog and now seeks to enforce a no dog clause that could be problematic for LL--but that does NOT seem to be your fact pattern.

Eviction On Door

Losing It All, I don't mean to be rude, but in what fantasy world would a landlord actually want to keep a tenant who's suing them? Of course the landlord wants to serve you with an eviction notice, and any normal person in your position would want to move if they had such a problem with their landlord that they felt compelled to sue them (never mind the depravity of people in our so-called culture jumping to sue at the slightest provocation).
Why don't you just vacate the property instead of going through the eviction process and getting that on your credit report? You may think that by suing your landlord you're going to somehow prove some point to someone, but the fact is that any landlord worth their salt is going to perform a background check on you before signing a lease agreement with you in the future, and they'll find that lawsuit on your public record, and they won't lease to you.
PS - if anyone out there wants to view a sample eviction notice...
Good luck, _________________________ Brian

I truely believe that this all came about because we are suing her. is it legal to but a eviction notice on our door? ( it wasn't sent through the courts) and can she have us leave that quickly?
