Indiana: False Claim For Replacement Of Carpet

Indiana: False Claim For Replacement Of Carpet

Postby taggart » Sun Dec 15, 2013 12:19 pm

I not too long ago ended my lease with a enterprise correct here in Indiana. In my deposit deposition, I have received a statement that they are charging me $884 to replace the carpet, that becoming the prorated cost for the estimated 4 years of life left to the complete apartment's carpet.Nevertheless, on the stroll-by way of inspection, signed by me and their designated representative, there was only mention of a single room needing replacement of the carpet, and that is the smallest bedroom. We are not disputing the charge to replace the carpet in that single region, but rather a prorated expense to replace the total carpet in that apartment. We have dated images, displaying the circumstance of the carpet, such as the discolorations in the smallest bedroom. The carpet is sectional, enabling them to replace the carpet in a single space, so do I have a case at all to contest the comprehensive quantity, and reduce it to the expense to replace the carpet in that single region?

They'd just be eligible for the depreciated value of 1 space of carpet. One space of rental high quality carpet must not price tag over 150 - 250 and would be depreciated down seriously to 75 - 125.You might check with an area carpet shop to verify that with the space sizes and obtain a published estimate. Then I'd write a letter requiring an adjustment inside seven days and adhere to with case if I did not get it.My person technique would be to complete the small claims complaint kind and add it to the letter. It is as significantly as you if you want to achieve that.

You certainly do. If they kept the deposit money you need to sue them in small claims. If they want a check, don't pay it and wait for them to sue if you cant reach an agreement.

She mentioned that absent that was her problem. They've also delivered an updated copy of the walk through inspection, using their alterations. The modifications for the inspection sheet are dated 8/10/2008, that will be nearly per month directly after we shifted out.I have my first copy of the inspection sheet, thus might this be viewed fraud? Since used to do not accept the up-to-date sheet.Any tips in regards to what I must do next?
