May I Still Prosecute?

Postby Doogan » Thu Mar 27, 2014 7:25 am

My buddies and I have been in a little of the hole. We've a buddy who'd been there for us and sometimes had given us money. A couple of years previously he'd a terrible moment and everybody lent him money. He settled some back, but could not pay back everyone that he still owed. Everybody he still owes money decided to let him take his time paying people back. He declined to sign something stating we're buddies and it should not arrived at that. I did not give him cash, but I purchased anything for him and he decided to pay me back for it the next week. I still have bills on most of what I purchased. This converted into evening, days, and months. I was prepared to prosecute earlier this season. Florida includes a 2-year restriction on verbal contracts that ended on this situation in February. Around that point he really got his life together and got a brand new work. As income got in certain folks began getting paid. I understood the law was endind so myself and others he owed money talked to him and chose to let him pay us again as he got money. We didn't let on the statute of limitations was moving, but we understood it was. Because we were going for a chance on his paying us back we chose to make it clear verbally (since he refused to sign something) we made it clear to him this was a brand new contract and not only a continuation of the previous one. We were confident he'd pay us back so we did not worry an excessive amount of about any of it. Well, today he claims that his employer isn't paying him, but we've no idea why, if this really is correct, he still would go to work and appears to have cash to invest constantly. We truly do not understand what to complete today. Some people are fortunate and may still prosecute because the law isn't up. But myself, it's been more than 2 decades. I've maintained all bills and have had witnesses everytime we mentioned his debt in my experience. Do the changing times I offered him extensions and whenever we renegotiated what he owed everybody (he owed me one large sum and many smaller ones, he decided to simply combine it into one large sum that he offered to cover me last month) do something for my situation or is it "sorry, its been more than 2 decades, you are SOL"? Some have said we ought to simply make him sign a promise to cover us back and that might count as a brand new contract, any ideas on that?Sorry for the complicated tale. Thank you if you can assist out.

"is it "sorry, its been more than 2 decades, you are SOL"?"Yes."we made it obvious to him that this is a brand new contract and not only a continuation of the previous one."Does not function that way. Try telling that to some judge and you'll discover the hard way.Either do not give money to friends or have it written down before you give the money and impose the fee contract from evening one.
