Reselling A Product Under A Different Name And Packaging

My question involves business law in the state of: New Mexico... however this would be online.

I'm wondering if anyone can point me to a law resource detailing the rebranding / resale of existing products.

My wife is a "consultant" for a company that pushes candle products. They currently ban consultants from doing any sort of advertising, which, as you'd expect, severely limits your ability to get new customers. I'm curious if it's legal to rebrand these products so that it's essentially the exact same item, but under another company's name. This would not be an attempt to "rip off" their product or undersell their prices in any way (in fact, that would lose us money!), simply allowing it to be distributed to more customers with a very small extra bit of profit tacked on. Additionally, they could be reformed to distinguish from the original design (after all, it's just wax.)

I have no doubt that it would. She'd obviously have to stop being a consultant and we would simply buy the product from a friend or something.

Your wife needs to read her contract. I expect that this plan would breach her contract with the supplier.

If they're just candles, and she doesn't want to use the company's brand, would be willing to modify the product's appearance, etc., why not learn to make candles, or hire a local candle maker to produce them? to do otherwise seems like a lot of bother and unnecessary expense.
