I recently moved out of a owner occupied home with two apartments other than the owner. The LL passed away and her daughter-then put the house on the market ASAP and told everyone they need to be out-within 2 months-She has been out for me since day 1-and was recently asked that she provide me with where my security deposit was, the interest amount and by law she needed to do within 30 days. She complied with the 30 days but failed still to provide me with the interest rate to this day! She said how dare I say that it is "the law". I moved out on November 24 and before hand took the interest (that she had never provided to me or showed me in 6 years) and deducted it from the rent (needless to say she went crazy!) She failed to return my security in 30 days as she did not believe that I moved on the 24th. (I have truck rental paperwork to prove so) I filed papers in small claims for the security on the 26th as it was still not returned and therefore over 30 days by law. I then got the check later that day-it says that the carpet (mind you was over 20 years old in one room and BRAND NEW in the other room) was destroyed and she should have deducted for that but she pity's me and how dare I again say it is the law to take my interest money....blah blah- Bottom line is that I read that you can compound the interest on the security by 7% per year if they fail to comply with providing you information on the security- is this true?? Even know it was 2 apartments and owner occupied. Second- I have pictures of how clean that apartment was-and she has threatned me that she will tell her attorney of the damage and proceed further-the funny thing is that she never ONCE DID REPAIRS ...I had her sister, sister in law and aunt tell me that it was ok to paint-she she had not done so in over 7 years-and she is claiming now that she never gave me permission too-(it was her mothers home) everytime maintenance was done...pipes broke or anything her cousin and I both forked out money to fix it. I never thought being it a family friends home and never renting before that I would have to save reciepts. How does this hold up in court-?What are my chances of winning this?

Also forgot to mention she just sold the house to a builder for 1.3 million dollars-but is still claiming damages that according to my pictures are obvouis wear and tear and I have piece of the old carpet and new carpet- the mold to the carpet and the padding that just crumbles in your hand!

Recommendations from the LL:I believe you're losing lots of time for you to find the compound interest restoration. Atleast in my own go through the curiosity I get after expenses on remains is very low so 3 X low continues to be reduced. I suppose from you rpost she delivered your deposit?Our study (although not of NJ regulation) is the fact that is LL is overdue in reaction regarding safety deposit (the one month principle) then your LL has basically shot himself in base to boost overdue harm state--I Would simply delay and find out what she dos--protect subsequently if necessary.
