Sue For Decline Of Home?

Are you able to prosecute your town or perhaps a creator for creating something which devalues your home? We're battling our planning fee simply because they wish to permit a creator to create an 18 wheeler entry road (to get a shopping mall) only 35' from our backyard--no fencing or something, simply little bushes and shrubs alongside the street. The street may operate all across the neighborhood and certainly will complement 8 additional meters. This property was previously meadow and got rezoned--we dropped that battle. We all know this street may devalue our property.

I don't see where you'd win that one---but if the facts run in your favor you may be able to win a tax reassessment appeal based upon your new lower market values

Wow, that would be hard to prove.
What about getting an appraisal before construction on the development and access road begins and one after all is in place?

How would you PROVE that your property is devalued.Notice the emphasis on PROVE.You don't win lawsuits or get lowered assessments by knowing. You win them by proving.

That would certainly be a good start.But before you spend the money on two appraisals, you'd probably better consult an attorney.It occurs to me that, if the zoning decision was done legally, you might not get anywhere with a lawsuit.
