Hi,
I'm not familiar in any way using the court program or creating a state, therefore I'm wondering if anyone thinks I'm losing my time or if I must follow more.
I purchased an 04 Mitsubishi Eclipse in July. While I purchased the car, I'd a ($100) 105-stage examination completed, that led to a 4-page statement describing anything that may be wrong with the car. The motor was in excellent condition.
On 16JAN I'd my oil changed at wal-mart. Did not notice anything wrong, I do not create a habit of checking the liquids until something smells funny or perhaps a light occurs (it didnt). I didnt push the car greatly in January, it had been mainly relaxing in my own garage. I required a visit down seriously to Denver (~460 kilometers one of the ways, 980 total) on the 24-26FEB weekend. On 28FEB my car completely died and the Service Engine light came on.
I'd it towed into a repair center, and the very first issue I was requested was "Who did your last oil change?" Evidently I'd been operating it for quite a long time with no oil. The motor is totalled, and estimation is $5500.00.
I submitted a claim through wal-mart, who delivered it to the State Office, who refused the claim. They're saying theres no method for them to understand another person did not remove the Gas Plug because it was 6 months prior to the vehicle died.
1. I've paperwork ideally displaying this is not a "fraud", the motor was in excellent condition less than six months preceding.
2. The storage store claims there clearly was no Gas Plug. I did not eliminate it, and nobody else did, leaves the very fact it was reinstalled improperly (by Wal-Mart). I've no method of showing if it sprang out one hour after the oil change or per week after (minus the plug, the oil might have gushed out such as for instance a tap, wherever i was operating -- wouldnt be any puddles in my own storage or something)
3. When the Gas Plug arrived on the scene, its nothing like the vehicle might have died instantly. It was probably the visit to Denver the weekend before that tired it (hence the wait in Oil-Change VS Demise of Vehicle).
4. While Wal-Marts "auditors" found consider the vehicle, they described A. Wal-Mart specialists make use of a Orange Color on the Gas Plug, to exhibit it was set in. The paint band on my vehicle was a lot more slim than regular (described 1cm?), indicating the Gas Plug was probably not fixed completely and W. Our paperwork wasn't signed-off with a supervisor (will often have a supervisor reviews the job?)
Quantity 4 would not truly assist me in court, Iam accepting thats whats called hearsay (no way I'd have the ability to obtain personal Auditor into court for me)...
Am I wasting my time looking to get repaid? I cannot answer why the Gas Lighting didnt come on, and unsure when the reality it didnt come on could be against me.
