Adidas Trademark Counterfeit Email From Ebay?

Postby blaeey » Fri Jun 15, 2012 7:17 am

I received an email with a pdf file from GIBNEY ANTHONY AND FLAHERTY LLP regarding "illegal merchandise" from ebay. I sold Euro 2012 jerseys on ebay and was flagged for infringement. My ebay account was banned and now they asked me to surrender the merchandise and provide who supplied them. These jerseys to me were absolutely authentic with tags on them with adidas barcodes I did not know if they were counterfeits and I still believe that they are authentic jerseys. How do I proceed with this? They said if I don't send them anything by June 21 I will be held responsible for legal actions. I don't want any legal action taken against me and want to get this out the way as soon as possible.

I received no email from any buyer who even questioned them so the thought of them even being 1% counterfeit never came up. I received all positive feedback and all buyers were happy with the product. I suspect that they are coming at me because I am selling them below Adidas's price.

You need a lawyer. Could be a scam.

Found a forum where a number of people indicate this is a scam: http://www.worldlawdirect.com/forum/copyright-trademark-patent/10825-cease-desist-letter-adidas-america-inc-10.html

Check out Davids link.

I started with the first one and read for awhile, it was interesting.

Basically, they send you a letter, then a second one. The second one from what I read is where they say if you 'remit' a check for 450.00 (+/-), they'll drop the whole thing.

Most who contacted an attorney and had the attorney reply to them, never heard from them again.
