Are schools allowed to put your phone in a safe ?

Postby denys » Fri May 11, 2012 11:18 pm

i don't want "you shouldn't take your phone to school" i only take mine cause you don't know who is about these days and i walk to and from school all day cause im on a revised timetable and im 14 so you can never be too careful. But is a school allowed to take your phone off you (which is your property) and confine it in a safe? I want people who actually know the law and are not just saying that they should be allowed. because most people nowadays are quite greedy and have expensive contracts so if they do take the phone are they supposed to pay for the amount of time its been taken off you ? i.e. if you have a £18 a month contract and its taken off you for 5 weeks should they have to pay £22.50 because 18 / 4 = 4.50 + 18.50 = 22.50 i know that they can take it off you if they give it back at the end of the day but are they allowed to take it off you and keep it in a safe until they think you deserve it ? i don't people saying that i shouldn't have my phone at school because i told you all at the start so people that actually know the law can you please answer ? thanks in advance :)

This is not a matter of law, it is a matter of the school policy.

Yes, the school can take your phone away on school property if it violates their policy.

No, they don't have to reimburse you for lost time.

No not for that length of time. I think a full school day would be acceptable. It's more down to the school rules to be honest.

The first thing you need to do is read the school rules and policies about cell phones. If the rules and policies say they can take your phone from you during school hours, it is safe to presume that doing so is within the laws. If there are no rules and policies, then you can call your local prosecutor's office and ask.

Yes schools are allowed to take your phone and keep it until they decide you get it back. It is called punishment for breaking the rules. Your parents signed an agreement with the school you would abide by the rules. Break the rules and get punished. No law states otherwise. And NO they do not have to pay while they have it.

They have to give it you back at the end of the day they can't just keep it get your parents on the case. ok don't listen to most of these idiots they know nothing for one if its your parents paying your bill they own the phone not you so yes your parents can and will get your phone back keeping your phone locked away does what purpose exactly apart from keep you from calling emergency services if you need to your teachers are wrong to keep it for more than a day teachers do not get special treatment when in concerns taking peoples belongings if half these people who think the school has a right well what do you think would happen if there bosses took there phones of them at work do you think the would allow it would they hell so why should you England's full of idiots who think there above law. like i said get your parents to go in get your phone then you'll know that half these people are idiots for sure.
