My ex was infected with herpes prior to us dating and did not tell me. Here in Milwaukee, our clinics will not test for herpes unless you have visible symptoms so a culture can be taken. So I had no way of finding out besides him telling me, and he opted not to. After a year of dating, I saw his prescription for Acyclovir and Googled it. I was shocked and frightened that it was used to treat genital herpes. I questioned him about it and within a few days, developed a single sore and was diagnosed with herpes. I have a recorded conversation in which he asks, "Why are you so mad at this?", and I respond, "I have herpes because of you! There's nothing I can do to change that!" He responds, "What was I supposed to do? Just tell you baby I have herpes?" Our names were used as well. Wouldn't this be enough for a civil suit against him? And does anyone know law firms here who handle these cases?

Wisconsin is one of the few states that has not criminalized the knowing transmission of STD's, but civil remedies are available. I have an uneasy feeling that you might not get much out of this though, and taking it to court would be very embarrassing.

Yes i would sue him. He was not suppose to have sex with u with out telling u first. And did he use something to protect himself. He act like it is not a big deal. Yes it is a big deal. Yes u can get a lawyer that will do that case. U should look in the yellow pages and find a lawyer that will take that case. Don't put it off, do it right away. I am so sorry that happen to u. So he was with someone else that had herpes. The doctor's should be able to do a test on u after u tell them the story about your ex. Or he can go to jail. I knew a case like that and the health Dept. were looking for that person. Call the health Dept. on him. I will be praying for u. And what ever u do please pray for your ex too. Because he needs help to. He was making sure that u will not be with anyone else. My God can work it out for you. There's no saturation that God can't handle.

Yeah, you can definitely sue him, and depending on your jurisdiction, he can actually be charged criminally.

Now, the recordings could be a problem because in some states, you need permission from both people in a conversation before you record it. So, you may have committed a crime by recording the conversation in which case, the recordings wouldn't be admissible in court.

The other issue is money, a lawyer is only going to take this case if there is a pay out. Does your BF have a 30 or 40 grand in the bank or his he making $10 an hour at Wal Mart? There's no point in suing someone for damages if the can't pay.
