Between January and May 2010, Tamika received five anonymous
handwritten letters that were extremely offensive and accused her spouse Jamie of
infidelity. In June 2010, Tamika’s friend, Ajay, received two anonymous offensive letters that
accused his spouse Fran of infidelity. The letter that Ajay received in June appeared to have
been written by the same person who wrote letters to Tamika between January and May.
Ajay told Tamika that he suspected one of his co-workers, Brandon, had written the letters
to him and Tamika. Ajay and Tamika decided to pursue a private investigation against
Brandon to confirm whether Brandon was indeed the individual sending them the harassing
letters. Following the investigation, Brandon filed a civil lawsuit against Tamika and Ajay. In
his complaint, Brandon alleged the following facts:

(1) Ajay told Tamika that he “never liked
Brandon” and he “wanted to make Brandon suffer.”

(2) Ajay and Tamika devised a scheme
to falsely accuse Brandon of writing the letters.

(3) Ajay and Tamika provided a handwriting
specialist with samples of Brandon’s handwriting which Ajay obtained by secretly going
through Brandon’s desk after work without Brandon’s permission. These samples included
copies of several personal letters Brandon had written to friends and family members that
he had not yet mailed.

(4) Ajay and Tamika sent a private investigator to confront Brandon
on three occasions and threaten him with criminal prosecution for harassment that “would
put him in prison for years.”

(5) Because of the actions of Ajay and Tamika, Brandon
suffered a mental breakdown and severe depression causing him to have recurring
nightmares, repeatedly miss work, become reclusive, and undergo extensive therapy.
Based solely on the facts contained in Brandon’s complaint, which tort most likely forms the
basis of Brandon’s complaint against Ajay and Tamika, and why? If all of Brandon’s
allegations are proved to be true, is Brandon likely to be successful in a lawsuit against Ajay
and Tamika? Why or why not? Explain fully
