Hi Gerry,

Hyspan Precision Products Manufactures Expansion Joints and we have a maufacturing plant in Chula Vista Ca, and a Maquiladora plant in Mexico, which is part of the NAFTA agreement. We are very confused about what can be produced in Mexico.

Because our plant in Mexico is part of NAFTA, can we manufacture product there which has the stipulations/requirements of the ARRA or the Buy American Act?

Hi Peter,

NAFTA signatories Canada and Mexico enjoy full exemption from the BAA and ARRA procurement requirements the same as Trade Agreement Act and designated underdeveloped countries listed under FAR 25.000 are. Therefore any products manufactured and originating from your Mexican operations are not required to comply with any Federal procurement restrictions that invoke FAR 25.000 and subparts, ARRA Section 1605 and CFR Title 48 with respect to country of origin.
