Ca rental law concerning amount of tenants in a one bedroom apt.?

Is it legal for two adults and two small children to rent a one bedroom apartment? Is it up to the discretion of the landlord/ manager, or a case by case basis? My landlord refused to allow me to move my gf and her two young children into my apt although I explained that since I am working out of town and come home every 2-3 weeks for the weekend it would essentially be just the 3 of them untill my work brought me home for good and at that time we would look for a 2 bedroom.

2 adults plus one child under 12 months old is the most you can have.

CPS will take those children into protective custody if the mother is neglectful enough to move them into there.

NO you cant have 2 kids and 2 adult in an 1 bed flat. you cant all sleep in 1 room its against the law! and the landlord could get in big trouble and lose everything! you need a 3 bed house because kids are not aloud to sleep in the same room unless they are the same sex not a 2 bedroom! the law is 2 people in a 1 bed flat in a studio its only aloud 1 person! 2 bed flat is only aloud 3! if you get a 3 bed house you will live more better and not have to worry about a think and will not have to move for a very long time!

It is up to the city laws and/or the landlord.

I think you are overlooking the fact that you are the tenant, the lessee, and you are allowing someone else who is not on the lease, to remain there while you are gone. That is cause for eviction. Your girl friend must be on the lease and be processed as a tenant. Could be thats why landlord wont allow it.

4 people in a one bedroom is most likely against fire code laws. Either way, it's totally up to the landlord. You can't just move in whomever you please. Most counties have a 2 heartbeats per bedroom law.
