Can a company use a phrase that has been used in articles, as their slogan?

Can someone file a lawsuit for the use of a phrase that is not officially trademarked but was used as a statement in or title of an article?

Just a random example: "The Key to Success". Let's just say that the phrase is not very popular but isn't completely unique, can a company legally use it as their slogan?
