My husband was convicted of agg robbery in 2001 and served time, however, he didn't commit the crime. He was living his life normally all the way up until recent events. On September 8, 2010 he was detained by immigration for that offense. We, now, have 2 very young children that they are trying to take him from. Under state law, it is too late to get the case reopened and our family is having a hard time trying to get him to stay. We have a lot of proof that exonerates my husband from committing the crime. We're not trying to sue for false imprisonment, but for the pain and suffering that my children will experience for losing their father and how I'm supposed to support my children without him because of the mistake that our state has made. Is it beyond the statute of limitations?
