Hello,

I own and operate a small mom and pop furniture store in Houston, TX. Customer comes in and orders a table from the catalog. We order it and ship it and he says this isn't what I ordered.

This is what he ordered, this is what he received. There were no mistakes made. Our policy is no refunds no exchanges. It was clearly shown on his invoice what he ordered, his signature is on the the invoice as well. If I truly did make a mistake I would switch it out no questions asked. But he simply isn't happy with it and wants to blame me.

Long story short he is blasting us on the net for cheating him and ordering the wrong item.

Can I sue? Small claims? Get a lawyer? How much do I sue for?

Maybe you ought to rethink your "no refunds, no exchanges" policy if it generates this much hostility with your customers.

If the merchandise was not up to the standards promised, you would not have a complaint. However its bad customer service to not have a reasonable replacement policy. This kind of business practice is not going to get you a lot of repeat business.

No, you cannot. Otherwise, every person on Ebay and Amazon could sue the heck out of their customers.

You are the one who refuses to do exchanges or refunds. That is your problem.

You're out of luck. You should feel lucky that he doesn't have his credit card reverse the charges. He has the right to have it reversed.
I don't understand how companies like yours stay in business. Customer service is necessary for a successful business.
You would do well to rethink your policies, if you wish to remain in business.

This is America, you can sue a cheeseburger for being a food. Since you stated that you have proof of what he ordered, Was your reputation damaged because of this? Did you become emotionally distressed because of this? Did you lose your job because of this? If the answer is no to any of these ,you won't win. However if you still think you can win, talk to a lawyer about this. If he thinks you have a case then you can put it in a small claims court. I don't think you would win unfortunately.
