Can my dad legally kick me out of my families house NEED AN ANSWER ASAP COLORADO LAW?

Postby bergh39 » Tue May 15, 2012 9:40 am

So i am a 19 year old college student who has lived in this house my whole life. My mother and father are equal cosigners on the house. My mother moved down to florida with my sister last year to get away from my father and i went away to college for a year. I will be moving back into my house for the summer. But my father has become a wild card since returning from Iraq, i honestly do not threaten him, disrupt the living enviroment, or cause any fights, he just sometimes goes a little psychotic (either because of PTSD or the pain medication he use to be addicted to). Last summer while my sister and mother were in florida (i was 18 at the time) my dad basically forced me to move out of my house, shutting off the water, internet, and my phone until i left. I am afraid while living there again a situation like this would happen again. Are there any statutes in Colorado saying that he cannot legally kick me out of the house if i am paying rent to my mother, working, and going to school? My mother is an equal cosigner and says it is fine if i live in the house. Also i am currently trying to find another living arrangement because that is the obviously the best situation. let me know if you need more details this is a hard question.

This is entirely between your two landlords. If one tells you that you can live there ans the other says no, the law really isn't going to come into it. He can have you evicted, and since you have been out of the house, nothing will force him to let you back unless your mother gets a court order to do so.

You do not own the house. You are an adult.

You are correct to find other living arrangements.

I am very sorry that your father and others around him are suffering.

You keep saying "MY house", but it is not your house. The two owners of the house have to be in agreement; if one objects the other cannot override them.

If you have a lease that both parents have agreed to, then he cannot just arbitrarily change his mind. But I suspect you do not have a lease, and it does not sound like your father would agree to one.

You will need to make alternate living arrangements if you cannot work this out comfortably with your father.

blah blah blah... long and short of it... it's not yours so move the F**K out of it... you are trying to play your mother against your father. if one wants you out than you need to get out. he is the landlord and he does have to go by the law. since there is no contract, you are living there illegally and he can have you arrested for trespassing. you are wrong and you need to get out of the house...

You are an adult and he is owner of the house.
Yes, he can throw you out.
You might be able to get him declared mentally incompetent, but that will take time and money.
AND all that will do is put your mother in charge of the house. She can still kick you out.
