Can my employer pay me less for doing the same job as everyone else?

Postby akule76 » Tue Jun 19, 2012 12:46 am

I was on a six month contract, and now it has been signed as a permanent one. My employer says all terms and conditions will remain the same, but I have been hitting very high numbers and targets consistently, and other staff in the same building who are doing the same job as me, but less work are going to get more money, as my temp salary was lower. Is this legal? I am highly sure that this is illegal. Moreover, they did not tell me that my temp contract annual leave would carry over if I was made permanent. Now I only have half my annual leave left, but they did not make me aware of this, and I would not have taken 10 days off had I know this! I think it is very unfair, and it feels really dodgy. Please can someone help, please just don't direct me to the Citizens Advice Bureau. I want help and advice from others who have been in the same situation. I would like replies from UK based people only, as I am based in the UK and would appreciate help from a UK based lawyer familiar with UK employment laws and policies. Any feedback would be much appreciated. I am doing the same job, but will be paid less. This is not acceptable. I work harder and have strict targets on a daily basis which I meet. Others who are permanent do not even meet their targets, and get paid more. We were told that after the six month probation, that the salary automatically goes up. This was verbally stated by the Operations Director.

yes it is legal since the Employer sets the salary. You do have the option of not working there

It is NOT illegal. providing they comply with the national minimum wages an employer can offer any staff member what ever they like. You were on a short term contract at a salary you accepted. They are offering you the same salary ~ initially ~ as a permanent staff member. if that is not acceptable refuse it, they then have 2 options, offer you more money or say good bye.
