I know of someone, from another country, that came regularly to visit (her boyfriend/friends) here in the US. This last time around, they got married. Just like many others, that just "wing it" and think that citizenship/adjustment of status happens once marriage occurs, they now find themselves in a world of mess.
In the midst of it all, she has overstayed her visa. Yes, bad idea. With that being said, they reached out to an immigration lawyer who says that her husband could apply for citizenship and, in return, can file for adjustment of her status(without her having to return to her home country)
Here's the deal. Her husband IS eligible to apply for citizenship as he has been here as a green card holder for over a decade. Although, he has been in trouble with the law and also has not filed income taxes for many years. He's sorted out the income tax situation and they are now concerned of if his criminal past will prevent him from getting his citizenship, of which, his interview is in two weeks.
Hypothetically speaking, let's say that he is denied his citizenship.
Does the wife have any other options to adjust her status?
Thanks!
