Can you file a civil suit against a phsysician?

A recent trip to the ER wound up costing me 3 days in the hospital less than 3 weeks later because the ER doctor failed to run a standard test for my condition. Instead he drug tested me because I asked for something for pain- I suffer from Muscular Dystrophy resulting in continued painful muscle contractions that can last for days. Now I have an ER bill that 73% of the bill is for an unnecessary drug screen and a hospitalization bill that could have been prevented if the proper blood tests were performed. I called a lawyer who says I do not have a malpractice suit because I did not sustain a lifelong injury but what about civil suit to recover lost wages and medical expenses due to the ER docs failure to give me due care given my diagnosis?

"I called a lawyer who says I do not have a malpractice suit" - It sounds like you have your answer already. Malpractice suits are a type of civil lawsuit.

Of course, you can shop around for a lawyer that will be willing to take your case. But if you get more and more lawyers telling you you have no case, it could be a good sign that you have no case.

You can file a suit against, chances are that you won't win.
