It depends on your state. In California, I believe it's after 2-3 years that tenants wouldn't have to be responsible for carpet damages especially if the carpet was old upon move in. I'd try to work out something with the landlord by telling him that the carpet was old upon your move in. If you've been there a long time; they shouldn't charge you for damages as the carpet should have been replaced. Did you take photos of the unit upon move in? If yes, you could probably sue them in court for your deposit. I'd call you local consumer agency and ask for landlord/tenant laws on this issue. I hope this helped.
