Condo Rental and Association By Law changes to Eliminate Renters?

Postby eorl » Wed Dec 21, 2011 2:36 pm

We had been renting a condo in Illinois and the association has brought up for vote to eliminate rentals. The document states that "all units are to be owner occupied at the recording of this amendment". By reading this I am understanding that the renters will need to vacate at this time. Does anyone know what the renters rights are on this? Also, 2/3 vote is required to accept this change. Any vote that is not turned in will be counted as a Yes vote for changing the By-Laws. Isn't this a skewed voting process?

Depends on what the by-laws say.

I'd take a copy to a real estate atty.

this vote could not impact current leases. Your current lease would have to be honored until end of lease term.
