Catherine, an author, agreed with a publishing company Law Publications Ltd to write a text book. The text book was in relation to a proposed statute that was currently awaiting royal assent. The contract specified that Catherine would deliver the manuscript within one month of royal assent being granted.
In reliance of the contract Law Publications Ltd. then spent 20,000 pounds of advertising and publicity material for the proposed text book. An unexpectedly large order from Wholesales public limited company for 100,000 pounds of text books was also received.
Catherine failed to produce the manuscript by the due and it is now 4 months late. Customers are now threatening to withdraw their orders.
Advise Law Publications Ltd. whether or not a remedy with be available against Catherine. In particular, Law Publications would like an order compelling Catherine to do what she said she would do.
