Facebook slander and the workplace?

If several co-workers are posting unpleasant things about another co-worker, can action be taken at the workplace legally? What are the laws about workplace discrimination while employees are not 'on the clock'?

1) I would report the Facebook activity to the human resources dept. at your company.

2) A company is a private organization and can set rules and policies at will, as long as the regulations do not violate existing laws.

3) I would consult with a lawyer if the Facebook postings are more than "unpleasant things."

{*} If the elements of a cause of action for defamation include:

A) false and defamatory statement concerning another;

B) The unprivileged publication of the statement to a third party (that is, somebody other than the person defamed by the statement);

C) If the defamatory matter is of public concern, fault amounting at least to negligence on the part of the publisher; and

D) Damage to the plaintiff.

The situation you describe has nothing to do with discrimination, so discrimination laws do not address such scenarios.

In most states, if some employees slander (or more properly, libel), another employee online, the employer may legally discipline and even terminate the offending employees. This is because any action that reflects badly on the employer, or negatively affects the workplace, may legally be dealt with by the employer.

Nobody is making you look at other peoples Facebook posts. If the people you're spying on, off the clock, are saying bad things about you then that seems like a good reason to quit pspying on them.

Slander is slander. You can sue for slander. But not in the workplace because workplaces do not have judicial systems. You will have to prosecute your slander claim in the state judicial system.

Are you sure that what you call slander is really slander? Many "unpleasant things" are not slander. You sound kind of like an idiot, and I am wondering how you can tell.
