Foreclosure law - what does this mean?

Postby francisco » Thu Mar 01, 2012 12:40 am

What does this mean exactly on an agreement: "waiving any possible rights which they may have to invalidate the foreclosure proceedings".

Had signed forbearance agreement without advice from a lawyer, and now house is in foreclosure with sale date is 2/3/12. I want to pay all delinquent amount and fees to stop th sale I just need to know if the above just means I cannnot sue them or go into bankruptcy to stop the proceedings.

Thanks, appreciated.

It means exactly what it says - you waived your rights to stop the foreclosure.

All is not lost though - banks really don't want the foreclosed properties and will sometimes work with you right up to the sale. If you have the money to catch it all the way up now, before the sale, call them. Alternatively, you can find someone to act for you in the sale, and their bid is successful, give them your money and make arrangements for a promissory note or mortgage to pay them back.

There are many ways to de-fur a feline, you just have to be aware of what they are. You made an enormous error waiving your rights, now it is time to lessen the damage by consulting an attorney.
