Going to court for a protection order filed against me?

Ok...my ex boyfriend filed a protection order against me on nov 1st saying that a threat was made early THIS YEAR that resulted in the police being called. First of all the police were never called to his house on the night we got into an argument nor have the police came to my house questioning me on anything so that is a lie. He had called his sister to tell me to leave the house and I did and that was the end of it and the relationship. ( All this happened on Feb 2011)

Next he said that I am trying whatever I can to get him fired from his job which I admitted to my lawyer saying that yeah I know that he does sneaky things at his job and I told him saying that If I would open my mouth to your corporate about this and that you would probably get fired. That what I would tell him every time I get into a argument that was like my line I would always use.

And lastly he put that I have threaten his family and friends with acts of violence..lol I have emails saying that I never said anything bad about your family and 2 or 3 weeks ago I called him up saying I wanted to get his mom a christmas gift because I love his mom she was really nice to me also I am friends with his friends and family I have them on my Facebook page and never threaten them or any acts of violence whatsoever.

I hired an attorney and she just called and went over saying that we have to stress to the judge that everything that he is claiming is OLD which it is all this happened like Spring of 2011. I have emails from him and me talking about going out, having sex, me and him celebrated my birthday together, he use to come and pick me and my son up and stay over his house, he would babysit my son for me, come over my parents house for sunday dinners and everything. My brother is coming with me to be a witness because he was there when my ex would come to the house and pick me and my son up or have dinner. Also I have a picture on my phone when he grabbed my arm so hard that left a bruise so my lawyer told me to print it out so it can show that I was never the aggressor in the relationship. Basically this was a love and hate relationship. I told my lawyer this also we would be in love one week then the next we would hate each other but we some how always made up and say each other. The last time I saw him was in September..twice both times we engaged in having sex I have emails that will show I am telling the truth.

Do you think that the case will be dismissed? I go to court this friday and I am nervous as heck because I know he is going to have things to make me look awful but I have emails and things that will make you scratch your head. If all of these things happened early this year why did you wait 7-8 months later to do something about it instead of still seeing me and hanging out. Don't you agree?

I called the police station and was told for me to get a police record I would of have to been arrested but I have never been arrested to this day and she then told me then more than likely the police weren't called on me

The judge will only grant the protection order if proof that you are a threat can be proven. In your case all the problems are old and basically unproven with no police report . Hearsay seems to be his best argument and you should be fine, Don't stress that's what lawyers are for.

For him to prove the police were called he will have to supply a police report, so if you were never questioned you are in the clear. I am sure there's more to your story but from the information based above it's hard to tell. He may have witnesses saying you've harassed them but it's interesting he's waited this long. Protection orders are so freely abused in this country that they lose validity on the cases that really need them. I hope he doesn't get one granted but from the sounds of it you should probably stay away from him and his family. Good luck.
