Personal injury claims not very.

Bodily injury claims often result in higher payout than insurance company originally offered but your attorney fees will take 1/3 or more of it, meaning the only one walking away happy is your attorney. I've seen many instances where the attorneys took so much the policyholder didn't get enough to pay the medical bills and was worse off than when they started.

Attorneys have their place and can be very very helpful, but be careful when hiring one.

Most claims do not go to court.

They are normally settled out of court. The insurance company you are claiming off usually require you to see a medical consultant to assess and report on your condition. Although they choose the consultant the consultant will treat you in an unbiased manner and the insurance company will then come back with an offer depending on that report.
