My father died 3 years ago without leaving any will. In property he has one 2bhk house at Ahmedabad city of Gujarat state of India. The surviving heirs are me, my mom, my sister and my minor brother (15 year old) & right now we all stay together in the same house. But we don't have knowledge about transfer of ownership. The house is still in my deceased father's name and light-bill comes in his name only. Someone told me that we need to obtain legal heir certificate. But how and from where to obtain legal heir certificate from Ahmedabad & what is the procedure. In Ahmedabad our house is under AUDA area. After getting legal heir certificate how to transfer the ownership in our name. What documents we will need? The lightbill still comes in my father's name, what do we do so that it start coming in my mother's name.

My mom is of opinion that we all 4 members (she and we 3 siblings) should become joint owner of the house. My dad didn't updated even rasan card until he was alive. In rasan card, old house address is mentioned and my little brother's name was not added after he was born. Now my mom don't know abt any procedure.

Before meeting local lawyer, I want to do some research on my own, so asking this question here, so pls kindly guide me if u know

First get the death certificate of the concerned .
Apply to the Thasildar thru an application mentioning all his daughters ,sons and wife for a legal heir certificate. The reason for the certificate also to be mentioned.
Fees stamp of Re.2 must be pas ted in the application form.
After perusal they will issue the certificate.
Good luck. After getting the legal heir certificate you can partition the party with the consultation of a lawyer
