Having an argument with a friend. If I were to buy a house before getting married, would the house be classified as community property if I got divorced? The deed to the house will be in my name and I will make all the payments. I say no, the house is separate property. My friend says otherwise, everything is community unless I were to get a prenup. We are talking about California law. Thanks.

What you invested in the house before marriage you will be entitlted to, all the interest/ added value to the house after you are married, you are entitled to half of and she, the other half.

Youre right its not! Property acquired before marriage, after seperation, pre-nup property & property inherited during the marriage isnt considered community property but seperate property, so the spouse isnt entitled to it or any portion of it in a divorce.

Han, don't get married if you aren't willing to take your vows "until death" seriously. You are already setting yourself up for divorce.

Your property remains your property if it was acquired before the marriage.

Two words for you: pre-nuptial agreement. Have one. End discussion.
