Integrity Products, Inc., obtains a patent on a valve. Jolly Company copies the design. This patent is infringed :

only if Jolly sells the valve in the market.

2. regardless of whether the valve is copied in its entirety or sold.

3. only if Jolly copies the valve in its entirety.

4. only if Jolly copies the valve in its entirety and sells it.

None of the above. The patent is infringed only if Jolly has copied the patented elements of the valve and attempts to make, use, sell or import products that include the patented elements.

1. Sales is not required. 2. does not include possibility of copying non-patented portions. 3. does not say what Jolly does with the copies. 4. is wrong answer for mirror reason of answer 2 -- Jolly could copy one small patented portion of the valve and sell it, thus infringing the patent, not "only" in its entirety.
