Is it legal for a landlord to stop me from keeping a gun in the house?

Postby motega » Thu Feb 23, 2012 6:01 pm

I rent a room in a house from a family. I signed a lease and there is nothing about guns in the lease. Now they are telling me that I am not allowed to keep two handguns and a rifle in my room and if I don't get rid of them I will have to move out. Can they do that? My guns are legal under Texas law.

Did you sign a month-to-month or a longer lease?
They do have the option of not renewing the lease at the end of the lease period.

If you are on a month-to-month, they can give you a 30 day notice for any reason.

BTW, an unsecured weapon can be considered a hazard, if they aren't stored in a gun safe. Your leaving guns unlocked in your room when you leave might be sufficient something that gives them legal leverage to get the gun out of their building before the 30 day notice is up.

It sounds like your living situation is a misfit. I would suggest you give your 30 day notice, store the guns elsewhere until then and move to a situation where you and your guns will feel more welcome.

it sounds like your landlords are scheming on you.

they want you to get rid of your guns (sell them for cash or something), so you have no protection.

then when you sold them, the landlords will break in your room and rob every thing including the money you got from selling the guns.

That's a good question. I don't see how they can stop you from having them if they are legal. If it was in the lease, that would be different, but since it isn't, I don't think they can say anything. I think I'll do a little research on it.

The property owner can ban guns from his or her property. Especially when you are just renting a single room.

It is not illegal see, since the house is owned by them, you are technically like a geust.

it is their house. put them in storage or keep them hidden. Don't you have a lock on your door?
