Is it legal for a teacher to keep all the students after class if..?

Postby barclay76 » Sun Mar 18, 2012 5:36 pm

there are two questions primarily i wish to have answered; first of all can a teacher keep the entirety of a class after the bell if the entire class did not partake in whatever "deserved" the discipline? what would happen if somebody who did not do anything but as they were instructed the whole period just left? is it false imprisonment in the first place to them? (if not what if the teacher tells you, you "have" to stay after? i understand that false imprisonment is majorly having to do with physically denying somebody movement, but what does verbally declaring somebody must do something count for?)
SECONDLY: if a teacher for example; assigns more homework for one or several peoples actions, is that against the law if so which; or what could i further look into for things relative to these types of topics? (in the Geneva convention im quite sure there was something like this but the geneva convention only applies to war related subjects.)

Legal? False imprisonment? Geneva Convention?

If it's done to keep you from watching so much TV, I think it's a great idea.

Both of these are legal.

As long as their actions comply with the law and school policy, teachers are allowed to discipline any student for any reason. They don't have to prove it was you, and it doesn't matter if it wasn't you who were responsible. Detentions within school hours, and outside of them, are perfectly legal. If they kept you in for an excessive period of time, you might be able to take some kind of action, but don't count on it.

There is definitely no law about assigning homework.

The Geneva convention doesn't apply to school punishments, unsurprisingly.
