Is this a case i can take to court?? Please Help!?

So recently i found out that my mother has contracted hepatitis B from an unsterilized needle, that has been used on other patients. She had been contracted about a year ago, and recently research and blood samples show that she has contracted it from the hospital. I am very devastated with this news and i want to make a case. I have found 2 good lawyers near my area of San Jose, Ca. One of them, Is Michael Dorshkind and the other is Jeffrey D. Janoff. I do have my mothers lab reports, although the doctors at the hospital my mother contracted the virus is not willing to give us the accommodation proving that it was their fault. which i can understand, no one would want and take responsibility from this accident. This case is defiantly under Medical Malpractice. I have spoke with Mr. Michael and He said that this is not a big enough case to take to court. If It was your mother, im sure you would be angry as well. She has to now live this virus for the rest of her life. I haven't spoke with Mr. Janoff yet, i left him a voicemail and hopefully he gets back to me, so i can ask him a few question.s To sum up this whole thing, im asking if i can make this a case, or if this is a big enough case to take to court. Another thing is that i have told my mothers other doctor at a different hospital and he is willing to help justify my case and is willing to answer the lawyers question. There has to be some sort of punishment because this is not right. It's a law that everything must be sterilized. Please give your comments on what you think. Thank you

Anyone has the right to sue for anything, so "can" you take this to court? Yes.

Winning is another matter.

If this is exactly what happened and you believe you can prove it, get a different lawyer to take your case.

I'm sorry that happened to your mother.

you can't take anything to court. Your mother is the only one who can sue.
You call it an accident but are alleging malpractice.
