Landlord NJ has accepted my family Back Rent,for Jan.Feb.then went to court to file for a eviction by Lieing?

lengthy but i feel i was ripped off,by crooked new jersey union county landlord please read
and give me intelligent,helpful mature, and factual answer thank you!it is mark,
Now:

i just receive now a Notice to terminate lease etc. MUST VACATE by end of march 31st 2011
or shall charge me 100 holdover fee(s)PER DAY for remaining there;

"while he is moving to evict me"
and the family...

Today in,the mail i now have a court hearing date?for next week on march 29 2011.

Now, i have PROOF we did pay all rent (late)for feb.and january 2011,he NEVER mail it back,

yet"went to court to say i want the family out"due to LATENESS of rent?"habitual"yet he again Accept both months that was late due to car accident,for which i am still recovering from(my dr.)
verify this it,if warranted,i have proof.so i just getting caught up on rent,and HE accept it.
So will i still be Evicted court date again is 3/29 for him lieing to court saying i did not PAY back
2 months late rent,yet again i paid by United StatedS Money Order,and clearly that is MY proof
that i mail it to him,CERTIFIED.

He surely has received my cash for the back rent,along with a signature i have from february.

Can i still be evicted when i go to court on march 29?

or at the LEAST get more time to stay even a full month,to find a new place as clearly

if the judge say i have to still "go"from being two mos.rent,etc. i need time to find a place etc.

((( i am being told NJ landlord usually"has to wait to file"until LEASE IS UP"then go to court to file for such removal of tenant)))and ONLY when rent is NOT paid,i think this is the law,am i correct?
Because he went to court sometime in feb.2011 yet again the RENT clearly was paid.i have proof?

AND:
COUNTER SUE for him lieing on me,by saying i did not pay when he has the cash from us for
a month now for both months/back pay rent...Only did not pay the 75 .00 late fee(s)Associated,
with it,this i have for court though,for which i have to now most like retain counsel for such case.

crook for sure,first why did he not legally give you rental receipt that your paying your back rent owed? he is in violation for this,your suppose to get a "Rental receipt"from LL,this is your legal right to have it" so that is great your able to "prove"your payin'the rent but no receipt from him,show he is shady IMO.Yes,your able to file a counter complaint/lawsuit(s)definitely,see how he likes that for the lie he told the court on you yep. definitely your able to file a lawsuit.
good luck,i think your going to be ok,if your able to prove jan/feb.rent is all paid up.
that only leave march and your able to pay this at courthouse,whether he want 2 accept it or not,
pay it at courthouse then tell judge,your needing time thru end of april or may 2011,to get a place.

i am sure they will understand with or without attorney especially when your all caught up.landlord sound shady,sooner your out the better. glad you have receipt for january and february rent.

hey Mark.first,member the KID,and Geena great post.and your both right,2nd year law student here.
most likely judge give a warning 2x late, your out,if your able to prove such case as mark say in a "serious car accident"or hurt and was out of commission,but now your fine then judge will always take this into consideration,but of course if i was you i will leave,just"save"the next month rent toward new place,why not?i know i will.and or read on i have more info on a personal experience here,but definitely go to court,or your atty.should as i am sure either way your not getting kick out in the next few weeks have to give ALL TENANT REASONABLY amount of time by law.

now,

i know by personal exp. i went court recently here where i live,judge went off on LL by almost similar case. your going 2 need the judge say a"valid reason",hence making some noise and rent 1 time or 2x being LATE due to accident,or a death in familiy,or workplace/job new etc. your not able to 1st time get judge to'"kick tenant out"and legally speaking mark,your lease is not up until march 31st so this guy is filing your eviction request to a judge since what?FEB/that sound illegal.
now:
IMO?
i say the landlord is a bum,why he going to "go to court later saying mark family did not pay up yet you have proof of the past 2 months? i would not pay 1 red dime any longer,UNTIL your in court to the judge or court clerk if u plan to stay past march 29.your maybe late with march BUT technically it is still yes MARCH,so your still having time to pay it if your planning on stay past march,even
then the judge case law,all states show judge will give some time 1 month or 2 to,find a place,no"same day eviction"will take place. nope.so your choice to either put march rent toward a new place,some people do or pay for the month(march)then still leave by end of april,or just tell judge"i need time to find new place"but will pay march/april and be out may 1st.good luck but yea he was suppose to give you rental receipt he did lie,and i will bring to judge attention,he file under false pretense to get you out. what a creep,what is his name blast him online so people there will know how this crooked loser is.

If you have proof you paid the rent and are CURRENT on your rent, show up for court and present it. Case dismissed most likely. Unless of course you repeatedly pay rent late.

"i think this is the law,am i correct?" - no, you are not correct. You can actually be evicted for repeatedly paying rent late, even if you eventually pay it.
