It depends on if some of the award is considered punitive. The part that is not punitive is NOT taxable. The part that is punitive IS taxable - and attorney fees cannot be netted out. In other words, if most of the award is punitive, you will owe a bunch of tax because you can only subtract out part of your biggest expense - the lawyers - like you can for most taxable income.
