Legal Question Re Neighbor's Fallen Tree Damaging Common Fence.

Our neighbor's tree fell into our backyard causing damage to our common backyard fence.  Are they solely responsible for the fence damage and cleanup?  What are our options if they refuse to act? (California)

Since it was their tree which made the damage then they are responsible for the expenses caused by the tree's fall unless the damage was made without their fault.
