I sold a skullcandy lowrider Black and gold headphones on ebay.

I got the preview image from google and copied the specification from skullcandys website.

After they got sold about 6 hours later i got a email saying


Thank you for your recent listing on eBay. Unfortunately, your item(s) breached one or more of our policies and had to be removed from the site. Any associated fees have been credited to your account and any bidders on this item have been notified.

The rights owner or an agent authorized to act on behalf of the rights owner, Skullcandy, Inc., notified eBay that this listing breaches intellectual property rights. When eBay receives a report of this type of breach, we remove the listing to comply with the law.

Skullcandy is a very well known eBay Vero program abuser. They will have every auction they can removed because they do not want competition (they sell directly on eBay, starting in the last year, check eBay user skullcandy). Even if the take-down is illegitimate, it's incredibly hard for a seller to fight back.

You should communicate with the buyer to make sure they understand the situation. If they still want the headphones you are absolutely okay to ship, but neither of you will get feedback for the transaction since it is essentially removed forever from eBay. As long as the buyer is okay with the transaction and they don't file a chargeback, etc., then there's absolutely no reason not to complete the transaction.

The sad thing is that it's a mark against your eBay account. The bonus is that you don't pay any eBay fees for the sale.

You are okay to send the item out. Ebay just didn't want you selling any more with that listing. You CANNOT pirate photos or info verbatim of any item, that includes other ebay member's photos etc. Be careful in the future.

Unfortunately I think you will find eBay will decline the transfer or ask for the money back.

Whatever you do don't try to fight this just give the money back and move on.
