I am a 21 year old male, my girlfriend is an 18 year old, neither of us have a past criminal history besides a DUI charge that i got back in 2010.

In february of this year me and my girlfriend were at a club in downtown edmonton, when all of a sudden a female bartender was throwing icecubes at me over the counter. i picked one of the icecubes up and lobbed it back at her and it went down her shirt. my girlfriend thought i did this intentionally so she got angry and we got into an argument and what not and we ended up outside of the club talking it out. she was crying and these 2 guys about 20-25 years old walked by harassing her saying 'quit crying like a little baby *****' and it made my girlfriend even more angry. she pushed one of the guys a couple times and i told them ' guys just walk away and leave us alone this is none of your business'. so they walked away and me and my girlfriend began to talk things out again. there were quite a few people around smoking at this point. all of a sudden those 2 guys came back and they seemed hostile and the one that my girlfriend pushed got right in her face and was harassing her again. his friend was standing in front of me and i told them 'guys just leave us alone why are u here again etc.' all of a sudden my girlfriend pushes the guy again and he then pushes her so my girlfriend started to swing, and the other guy standing infront of me jumped in and pushed her. so i hit his friend in the face and he tackled me to the ground, where we wrestled and rolled around a bit while the other guy was kicking my girlfriend on the ground, until police broke the fight up. the police took our id's and everything and i saw the guy that i was fighting with get into an ambulance. i explained it to the police that they were harassing us and i warned them to leave twice but they wouldnt, and once the guy hit my girlfriend i had to fight.

a month later, after finding out that my girlfriend is 5 weeks pregnant, the police show up at my girlfriend's home and tell her she's being arrested for assault causing bodily harm. they said that i will be getting charged as well and that i need to go see them. they said that the man that is charging us had to get 6 stitches around his eye and couldnt return to work as a welder because of it, and he also has an eye witness. so i turned myself in and they took my fingerprints and read me my rights. our court date was on April 25 but my girlfriend had not gotten a lawyer yet so she requested a letter of early resolution so the court date was pushed back 6 weeks. however they also told her that the charge is being changed to AGGRAVATED ASSAULT rather than ASSAULT CAUSING BODILY HARM. now our court date is in a week and my lawyer hasnt even recieved the police disclosure neither has my girlfriend recieved her letter of early resolution.

This is a very serious charge and me and my girlfriend do not deserve this. We are nice people are do not deserve to go to jail or anything. especially the fact that we are now expecting a child and we just got our own apartment a couple weeks ago in St Albert. We are very stressed out and anxious to get this over with and we just want another person's opinion on the situation hopefully that will calm us down.

I did not read all that mess but your girlfriend started the whole thing and is in serious need of anger management traeatment. God help any child she should ever have!

Of course she deserves it you could have gotten in the car and drove away!

You can go for self defense. not so much for your gf. She's screwed to be honest. the other people can be charged for harassment.

Probably no jail time. 2 years probation. Might be more with the DUI. When they look at your record and see the DUI, that is a big thing. It might get you jail time. Probably not.

You both need lawyers. You don't want to go into this without a lawyer, the risk is too big. A judge has almost unlimited power and you need someone who is trained to talk to him.

Your argument is "they started it". I'm guessing your not a parent, but just believe me, no one wants to hear that argument. I'm sure judges here that all the time. And I bet the other guys are saying you started it. Your lawyer will look at the evidence and will know much better then I do. But my guess is they will go with a plea bargain. It's not a strong case, so my guess is your lawyer will make you a deal that includes no jail time. Just do what your lawyer says and get through this. And next time you'll know to do more to avoid the fight. I'm reasonably sure that you could have done better.

Addition. Do you have a drinking problem? I'm just asking. If so then go to an AA meeting. At least once.
