In 2002 my brother was arrested for drug trafficing and he served 10 years in federal prison. When he got out he violated his parole and he was sent back to prison serve six months for his violation. The day of his release which was Dec 9 2011 the I.C.E put a hold on his release because my brother is a canadian citizen. He is still currently incarcerated at Theo Lacy Facility. my brother was born on July 1977. In 1988 my mother became a US citizen. In Feb of 1995 my mother divorced my dad and gained sole custody of me and my brother. I believe that if i read it right, the law clearly states that before feburary 2001 if a mother becomes a citizen and gains sole custody of there child before that child turned 18 then that child automatically becomes a citizen. Right now the I.C.E is holding my brother for no reason what so ever. He is clearly a citizen of the United States and this federal organization is clearly holding him against his will and they are breaking the law. I have every document needed to clearly prove every fact that i have listed. And I want to know that can I sue them for wrongful prosecution or sue them for anything??
