My ex said he will pay for damages done to my car but he isn't.. Can I sue him?

My ex beat up my car, my lap top, and myself. He has been promising to pay off all of the damages for 3 months. I have texts saying that he will pay. But I know he is telling me he will, but he won't. I want to sue him for the money so I actuality get paid.

I was doing research on suing him in small claims court.. but it says that I can only sue him if he deny's to pay it. My situation is that he tells me he will pay it, but will not follow through.

What can/should i do?

By NOT paying he is denying payment. Save the texts.

Did you file a police report and get a court order saying he had to pay? If not, you are going to have a hard time proving it.
