business. Also pays her taxes. Myself, US citizen, and also serving in the military. I am deploying in a couple months. Also currently on orders right now. I called Immigration and they said she may have to depart and apply there. I love my wife and can't see her leaving if i serve my country. Is anyone famaliar with this process? I am going to see a lawyer tomorrow. Also I heard there is something stating, if you lived here over 16yrs you can be eligible for citizenship. Someone please help me. Thank you and God bless.

PS. She has a daughter that was born here.

Was she brought here illegally? If so, that is why her mother never got a green card. Unfortunately, President Obama's order to give work permits to young undocumented immigrants doesn't help your wife because she is older than the cutoff age of 30. Your lawyer can help you two figure the best way for her to get papers.

She will have to go back to where she was born for a min of 1yr. She will have to apply for Citizenship as soon as she gets to where she should be. This process will take a year. But, have her do it on her own before she gets deported. This process may go faster because she has a child and her legal husband is in the Military.

It's a good thing that you and your wife are obtaining an attorney, because that's the best and only route to take with what sounds like a visa overstay (unless her parents entered illegally, and then it's still not over until it's over). Chances are, your attorney will help you file for her permanent residency with a hardship waiver. There may still be a chance that she could be denied, but that's pretty much true for all of us tied up with our own immigration cases. Best of luck to you, and thanks for your service.

there is no over 16 year rule ...
take the lawyer advice

An illegal cannot adjust status in the US
Marriage and babies will not help either ..that is a myth

To become legal you have to return home
